Terms of Service
Last updated:
These terms govern your use of Ikhaya24. By creating an account or using the service you agree to be bound by them. The service is operated by Ikhaya24 as the data controller, contactable at admin@ikhaya24.com.
1. The service
Ikhaya24 is a property-management platform for South African landlords. It helps you list units, onboard tenants, coordinate contractors, and track financials. It does not handle rent collection or escrow; rent flows directly between tenant and landlord. Subscription billing is processed by PayFast.
2. Accounts
You are responsible for the accuracy of the information you provide and for the security of your account credentials. Notify us immediately at the address above if you suspect unauthorised access. You may not share an account with another person.
3. Acceptable use
- Do not use the service to harass tenants, contractors, or other users, or to circulate unlawful content.
- Do not attempt to bypass tenancy isolation, scrape another organisation's data, or interfere with the integrity of the platform.
- Use the service only for lawful property-management activities in compliance with the Rental Housing Act, the Consumer Protection Act, and POPIA.
4. Subscription, billing, and cancellation
Paid plans are billed monthly via PayFast, in advance. You may cancel from your account settings at any time; cancellation takes effect at the end of the current billing period and no refunds are issued for partial months. We may suspend access on missed payment after a 7-day grace period.
5. Your data
You retain ownership of the data you upload. You grant us a limited license to process it strictly for the purpose of delivering the service to you. Our handling of personal information is governed by our Privacy Policy.
6. Service availability
We aim for high availability but the service is provided on an “as available” basis. We may schedule maintenance windows and will give reasonable notice for material outages.
7. AI-assisted features
Some features use automated reasoning to draft tenant replies, summarise documents, or suggest actions. These are advisory; you remain responsible for the decisions you take, including any contractual or financial commitments arising from messages sent on your behalf. You can disable AI assistance from your account settings.
8. Liability
To the extent permitted by South African law, our aggregate liability for any claim arising out of the service is limited to the fees you have paid us in the 12 months preceding the event giving rise to the claim. We do not exclude liability for fraud, gross negligence, or any other liability that cannot be excluded by law.
9. Termination
We may suspend or terminate your account for material breach of these terms or for unlawful use of the service. On termination you can export your data for 30 days; thereafter we delete it subject to the retention obligations described in the Privacy Policy.
10. Changes
We may update these terms when the service or applicable law changes. We will give reasonable notice of material changes; your continued use after the effective date is taken as acceptance.
11. Governing law
These terms are governed by the laws of the Republic of South Africa. The courts of South Africa have non-exclusive jurisdiction over any dispute arising from them.
